Uncertainty clouded the Omaha board meeting Monday night as several trustees stated they had been informed by the Gallatin County Clerk that any vote to change Omaha’s alcohol ordinance based on a recent petition, would be illegal without going to a ballot referendum vote. This contradicted the advice President Bob Lambert had received from village attorney Marty Watson of Eldorado, who advised him that, because the 2006 referendum was an advisory one, it was non-binding on the village, and that the board could vote to admit alcohol sales in Omaha. The County Clerk, in her findings, had consulted with the State Board of Elections, which made things all the more perplexing.
