Landon Rudy Rudolph received a partial victory this morning in White County Court as Judge Denton Aud of the Second Circuit gave him a partial temporary restraining order against the city of Carmi to halt any disbursement of city funds to a new law firm until the cCty Council is able to vote on a contract with Lashly & Baer. The contract was signed on August 31 by Mayor Bill Stendeback. At issue is whether Stendeback had the authority to unilaterally sign the contract without a vote by the city council. Mayor Stendeback signed the contract stating it was for emergency services he said were needed to answer all the FOIA requests and ADA issues. The FOIA requests were coming mainly from Rudy Rudolph, but a few were from others. The scope of the contract was not just limited to FOIA and ADA issues. Mayor Stendeback's affidavit indicated that the city attorney had other clients to take care of and would not be able to fulfill all of the necessary duties that were needed by the city.
